Terms of Service
Effective September 28, 2026
1. Agreement
Naming Thing (“the service”, “we”, “us”) is a lab project operated by Minute.tech. By using the service you agree to these terms. If you don’t agree, don’t use the service.
2. What the service is
Naming Thing generates name ideas using AI models and runs live, point-in-time checks on things related to those names — domain availability and pricing, social handles, web presence, and a keyword search of US federal trademark filings. All of it is informational. None of it is a reservation, a registration, a guarantee, or advice.
3. Not trademark or legal advice
Names the service suggests are ideas, not clearance. The keyword check includes a plain-text search of US federal trademark filings as one signal among several; it is not a clearance search, it does not cover state, common-law, or non-US marks, it can miss marks that are spelled or classified differently, and an AI model summarizes what it finds. Nothing here tells you whether a name is safe to use commercially. Before adopting a name, do your own clearance — including professional trademark searches in your markets — or hire a professional. You are solely responsible for the names you choose and how you use them.
4. AI-generated content
The names you make here are yours. Use them however you like, commercially or not. We claim no ownership over the names generated for you, we don’t license or sell them to anyone, and we won’t take them for ourselves.
They aren’t exclusive, though. Generated names come from AI models and may be inaccurate, unoriginal, or similar to existing brands, products, or trademarks, and the same or similar names may be generated for other users. Legal rights in a name, like a trademark, come from registering and using it — not from us. Use them at your own risk.
5. Domain and availability data
Availability, pricing, premium status, and for-sale information come from third-party sources (registry RDAP servers, DNS, and commercial data and pricing APIs) and reflect a moment in time. Registries and registrars have the final word: a name shown as available may be taken, reserved, or priced differently by the time you try to register it. Always confirm at the registrar before relying on anything shown here.
6. Accounts
Sign-in is by email link, so your account is only as secure as your email inbox — keeping that inbox secure is your responsibility. Provide an email you control. We may suspend or close accounts that break these terms or abuse the service.
7. Acceptable use
You agree not to:
- use the service for anything unlawful;
- scrape, bulk-query, or automate requests against the service or circumvent rate limits or plan restrictions;
- probe, disrupt, or interfere with the service or the third-party sources it relies on;
- resell the service or misrepresent its output as your own service.
8. Paid plans, billing, and changes to the service
The paid plans (Personal and Pro) are subscriptions billed monthly, in advance, at the price shown on the pricing page and at checkout, plus any tax that applies. Payments are processed by Stripe. By subscribing you authorize us to charge your payment method each month until you cancel.
- Cancelling: cancel any time from your account page. Cancellation takes effect at the end of the period you have paid for, and your plan stays on until then. Switching between Personal and Pro takes effect right away, with the difference prorated.
- Refunds: if a paid plan isn’t for you, contact us within 7 days of your first payment for a full refund of that payment. Otherwise payments are non-refundable and we don’t refund partial periods, except where the law requires it.
- Failed payments: if a renewal can’t be collected, Stripe retries it for a while; if it still can’t be collected, the subscription ends and the account moves to the Free plan.
- Price changes: we’ll email you at least 30 days before a price change, and it applies from your next renewal after that. You can cancel before it takes effect.
- Allowances: each plan includes the allowances described on the pricing page, counted over a rolling 30 days. They exist to keep the service sustainable and are not credits: unused allowance doesn’t carry over and has no cash value.
The service is early and evolving. Free features may change, gain limits, or be discontinued at any time. If we make a change that materially reduces what your paid plan includes, we’ll tell you in advance and you can cancel.
9. Third-party links and referral disclosure
The service links to third-party registrars and marketplaces. Some links are referral or affiliate links, meaning we may earn a commission if you buy through them — this never changes the price you pay or the order in which we present availability. Anything you purchase from a third party is governed by that party’s own terms, and we are not a party to those transactions.
10. Intellectual property
The service’s design, code, and content belong to us or our licensors. Your names don’t: the briefs you write and the names generated for you are yours, as section 4 says. You give us permission to process them only to run the service (including sending them to the AI and data providers that power it). We never sell them.
11. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE — INCLUDING RELIANCE ON GENERATED NAMES OR AVAILABILITY AND PRICING DATA. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF US$50 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
13. Indemnity
You will defend and hold us harmless from claims arising out of your use of the service in violation of these terms, including claims that a name you adopted infringes someone else’s rights.
14. Termination
You can stop using the service at any time. We may suspend or end your access if you violate these terms. Sections that by their nature should survive (3–5, 9–13) survive termination. If we end a paid subscription for a reason other than your breach of these terms, we’ll refund the unused part of the current period.
15. Changes to these terms
We may update these terms; the effective date above will change when we do. Continuing to use the service after a change means you accept the updated terms.
16. Governing law
These terms are governed by the laws of the United States and of the state where Minute.tech is based, without regard to conflict-of-laws rules.
